GROUP EXERCISE WAIVER AND RELEASE FORM I, _______________________________, have enrolled in the health and fitness program offered by Bendy Basics. I recognize that the program may involve strenuous physical activity including, but not limited to, flexibility and stretching, endurance training, cardiovascular conditioning, and other various fitness activities. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or otherwise limit my full participation in this physical program.

In addition, I am fully aware of the risks and hazards connected with the participation in the physical program including, but not limited to, physical injury or even death. I hereby elect to voluntarily participate in this program knowing that the associated physical activity may be hazardous to me and/or my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME, OR LOSS OR DAMAGE TO PROPERTY OWNED BY ME, AS A RESULT OF PARTICIPATION IN THIS PROGRAM. 

Conduct: Participants must behave in a respectful manner to both person and property. Behavior which could potentially lead to intentional or unintentional bodily injury or injury to property will not be tolerated.

Alcohol and Drugs: During fitness classes, participants must be of sound mind and body and not under the influence of alcohol or any illicit or prescription drug or medication which may in any way impair participant’s ability to enter into this agreement, fully understand the respective intent and meaning of all the terms and provisions hereof and to participate in the event. Participants may be asked to
leave immediately at the sole discretion of Bendy Basics team members, trainers, etc. if thought to be under the influence of drugs or alcohol.

Use of Image: Above named participant grants Bendy Basics the right to photograph and/or videotape and further to display, use and/or otherwise exploit name, face, likeness, voice, and appearance forever and throughout the world, in all media, whether now known or hereafter devised, throughout the universe in perpetuity (including, without limitation, in online webcasts, television, motion pictures, films, newspapers, and magazines) and in all forms including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes, including, without
limitation, publication of Event results and standings, without compensation, reservation or limitation. The Released Parties are, however, under no obligation to exercise any rights granted herein.

COVID-19: Bendy Basics requires all participants be vaccinated against COVID-19 and its variants. All participants must wear masks to participate. Should a participant refuse to wear a mask and/or maintain 6 feet of distance, they will be asked to leave. Participant who have symptoms of COVID-19, or who have come into close contact with those who have symptoms of or have been diagnosed with COVID-19, may not attend Bendy Basics sessions.

I agree to comply with the above COVID-19 Guidelines. Should I knowingly violate these guidelines, I understand that I am at risk of liability to Bendy Basics and other participants.
